Terms and Conditions

|
A. Sales Terms and Conditions: (1)
All orders require payment in full at time of purchase. Any change of
delivery address or change in the order must be made in person by the
purchaser at the location purchased. (2) Items shipped to destinations
in the California are subject to a 8.25% sales tax. (3) You must accept
delivery within 10 days after the merchandise has been received from
the manufacturer, unless otherwise stated on the front of this
contract. (4) Order deliveries are estimated and can take between 2-12
weeks from date of purchase until date of delivery. (5) No special
crating or packaging is available. (6) All mattress sales are final. |

B. Returns Policy: Returns
or exchanges will be accepted within 10 days of delivery and will be
less the actual shipping costs. There will be a 20% restocking fee for
each item returned. Item(s) must be in original packaging & must
not be assembled. Returns not in original packaging, or assembled items
will not be accepted for return. |

C. Refund Policy: (1)
Purchases may be cancelled in writing, at anytime before the delivery
date, but will be subjected to a 20% restocking fee + Delivery Charges.
(2) All refunds must be accompanied by original sales order receipt.
(3) All refunds of cash, check, and credit card payments will be
refunded from our main office and require an estimated 7 to 10 business
days for processing. (4) There will be no refunds on merchandise that
has been accepted by the customer. In the event that merchandise we
deliver has a defect, we will inspect the furniture in your home, and
repair or replace at our discretion. |

D. Limitation of Liability: Metropolitan
Euro Furnishings, its agents, owners, subcontractors or representatives
cannot be held liable for any damage to internal electronic or
mechanical items. Metropolitan Euro Furnishings has the right to
inspect and repair any alleged damage and provides no coverage for
cosmetic damage to any items. Metropolitan Euro Furnishings cannot be
held liable or negligent for any damage to the interior or exterior of
any residence including, but not limited to walls, hardwood floors,
flooring, ceilings, landscaping, sprinklers, plumbing, electrical
wiring, door frames, doors, lighting fixtures, etc. Customer who signed
this document agrees to fully indemnify Metropolitan Euro Furnishings,
its agents, owners, subcontractors or representatives from any lawsuits
or claims arising out of property damage or personal injury occurring
during the transport (to and from the destination address), delivery,
and loading or unloading, where said claim occurred on any private
property (condo complex, apartment complex, mobile home park,
commercial building etc.) where Metropolitan Euro Furnishings was
invited onto by customer to perform services. |

E. Mandatory Non-binding Arbitration: All
legal claims concerning this agreement or performance therein are
required as mandatory to be submitted through Arbitration, through JAMS
Arbitration. Each party is responsible for their own costs associated
with arbitration. A benefit to the arbitration alternative may be that
it is less expensive than traditional litigation. Each party is
responsible for 50% of the costs associated with securing the
arbitrator and 100% of their own expenses, including but not limited to
attorney fees and travel expenses. Arbitration shall take place in Los
Angeles County California. |

F. Exceptions to Carrier Liability: Metropolitan
Euro Furnishings shall not be responsible for loss or damage arising or
resulting from (a) Act of God; (b) Act of War; (c) Act of public enemy;
(d) fire; (e) inherent defect, quality or vice of the goods; (f) any
other cause arising without the actual fault and privity of the
Carrier. The carrier shall not be held responsible for any items
insisted by shipper to be moved through impassible passageways or other
impassible openings. |

G. Warranties: (1)
Our limited warranty covers 90 days. (2) Moving the furniture from the
original delivery address voids this limited warranty. (3) Commercial
usage will void this limited warranty. (4) Warranty claims may take an
estimated 30 days to process. |
|
H. Delivery Policy: (1)
If you need to postpone and reschedule your delivery, you must call
“Metropolitan Euro Furnishings” office 48 hours prior to your scheduled
delivery date. If no one is home for the scheduled delivery, you will
be charged another delivery fee. (2) You will be contacted a minimum of
24 hours prior to delivery and given a 4 hour window for delivery.
Requests for specific times may not be honored. Deliveries begin at 8
am. (3) Upstairs deliveries are subject to a $15.00 charge per flight
per heavy item. (4) Drivers cannot handle furnishings that are not
listed on the delivery documents. This includes, but is not limited to,
other furniture, appliances, doors, and electronic components (e.g.
televisions, computers, and stereos). Customer is responsible for
making room for new furniture. (5) Drivers cannot deliver furniture if
someone 18 years or older is not at home at the time of delivery. (6)
Customer is responsible for measuring doorways, stairways, elevators,
etc. to be sure merchandise will fit. Where it is found that
merchandise does not fit, you may select smaller merchandise or a
merchandise certificate for which new delivery charges will be imposed.
Alternately you may request a refund, less a restocking fee of 20% +
applicable delivery charges. (7) Claims for defective merchandise or
missing parts must be made within 2 days from date of delivery. |

I. Warehouse Pickup Policy: (1)
Metropolitan Euro Furnishings does not assume responsibility for
fitting furniture into the customer’s vehicle. (2) If customer decides
to return furniture for any reason, he/she is responsible for
transporting goods back to us. (3) No refunds will be processed until
items are returned to us in their original packaging. If original
packaging is not provided, no refund will be processed. (4) If
merchandise is returned for any reason, besides damage noted by a
customer service representative, customer will be subject to a 20%
restocking fee. (5) Customer is responsible for inspecting all items
for damage before leaving the pick up facility. |
